I'd prefer a new func attribute `@ctfe`.
Also I find the current implementation unplesant. Cant you just 
check the assertion when they are already visited elsewhere e.g 
in dmd.expressionsem.ExpressionSemanticVisitor.visit(AssertExp) ? 
Also what if we are in a contract ?
